ORDER DISMISSING PETITION FOR WRIT OF CERTIORARI
THIS CAUSE came before
the Court on the Petition for Writ of Certiorari, the Response to Petition for
Writ of Certiorari, and Reply to Response. Upon consideration of the same, this
Court finds that this action must dismissed.
Petitioners, each of whom own property near the land
rezoned, have
filed a petition for writ of certiorari seeking review of the rezoning
decision. In reviewing the petition, this Court finds that petitioner’s main
argument is that the development order is inconsistent with the comprehensive
plan. This action must therefore be dismissed because such issues are not
properly brought in a Petition for Writ of Certiorari. The sole action
available to challenge the consistency of a development order is an action
pursuant to Florida Statute 163.3215. Martin County v. Yusem, 690 So. 2d 1288 (Fla.
1997). It is, therefore,
ORDERED AND ADJUDGED that the Petition for Writ of
Certiorari is DISMISSED.
